Issues Fictitious Firm Names

It is required by Nevada Revised
Statutes (N.R.S. 602.010) that every person doing business in the state
of Nevada under an assumed or fictitious name which does not show the
real name of a person who owns an interest in the business must file
with the County Clerk of each county in which the business is being
conducted a certificate containing the information required under N.R.S.
602.020.
The clerk’s office is in the
process of getting a program to track fictitious firm names for White
Pine County. Once the program is completed, it is the intention of the
clerk to request that the County Code be amended to require that
fictitious firm names be renewed every five years. This will clean up
the old files and keep the information for our county current.
The application for a fictitious
firm must state the assumed or fictitious name under which the business
is being conducted or intended to be conducted by:
 | A natural person |
 | An artificial person required
to make annual filings with the state to retain its good standing;
its name as it appears in the secretary of state (for example:
Corporation) |
 | A general partnership |
 | A trust |
The filing of a fictitious firm
name does not give exclusive rights to the user. A fictitious filing is
required by statute (N.R.S. 602.010) and is also required by the
Business License office before issuing a license under a fictitious
name.
A person doing business in this
state without complying with the requirement under chapter 602 of the
N.R.S. or having falsely filed a certificate of termination is guilty of
a misdemeanor under N.R.S. 602.090.
Each individual business name must
have a separate filing. Multiple fictitious names cannot be included on
a single certificate.
Fictitious firm name or
termination forms may be obtained from an attorney or from our office.
Forms must be properly completed and all signatures must be notarized
prior to being presented for filing.
Filing fees must be paid by cash,
check or money order payable to the County Clerk’s office.
